Before releasing any person on bail or their own bond, the police officer or Court, as the case may be, shall require the execution of a bond for an amount deemed sufficient. If released on bail, the person shall provide one or more sufficient sureties. These sureties will ensure that the person attends the specified time and place, and continues to do so until the police officer or Court gives further directions.
When conditions are imposed for the release of the person on bail, those conditions must also be included in the bond.
If the situation warrants, the bond may also require the person released on bail to appear when called upon at the High Court, Court of Session, or another relevant Court to answer the charge.
To assess whether the sureties are appropriate and sufficient, the Court may accept affidavits verifying the facts about the sureties' sufficiency or fitness. If the Court deems it necessary, it may either conduct an inquiry itself or have a Magistrate under its jurisdiction perform the inquiry.
