CrPC Section-444 - Discharge of sureties

Description

  1. Any surety for the attendance and appearance of a person released on bail may, at any time, apply to a Magistrate to have the bond discharged, either in full or in part, as it applies to the applicant(s).

  2. Upon receiving such an application, the Magistrate shall issue a warrant of arrest, directing that the person released on bail be brought before the Court.

  3. Upon the person’s appearance pursuant to the warrant or voluntary surrender, the Magistrate shall decide whether to discharge the bond in full or partially as it pertains to the applicant(s). The Magistrate may then order the person to find new sufficient sureties. If the person fails to do so, the Magistrate may commit them to jail.
