If no person establishes a claim to the property within the specified period, and if the person in whose possession the property was found is unable to prove that it was lawfully acquired, the Magistrate may issue an order directing that the property shall be at the disposal of the State Government. The Government may sell the property, and the proceeds from the sale shall be handled in accordance with prescribed guidelines.
An appeal may be filed against such an order to the Court to which appeals typically lie from the convictions of the Magistrate.
