Section-15 - Determination of compensation

Description

  • Mental Trauma, Pain, Suffering, and Emotional Distress:

    • The committee will consider the psychological impact of the sexual harassment incident on the aggrieved woman, including any trauma, emotional suffering, or distress she has experienced.
  • Loss in Career Opportunity:

    • The committee will take into account the impact the harassment has had on the aggrieved woman’s career, including any lost professional opportunities or setbacks in her career growth due to the incident.
  • Medical Expenses:

    • The costs incurred by the aggrieved woman for medical treatment, whether physical or psychiatric, will be considered. This includes both direct medical expenses and treatment for any mental health or emotional consequences of the harassment.
  • Income and Financial Status of the Respondent:

    • The financial condition of the respondent will be evaluated to determine the amount of compensation that is feasible. This ensures that the amount to be paid is reasonable given the respondent’s financial ability.
  • Feasibility of Payment:

    • The committee will assess whether the sum should be paid in a lump sum or in installments. This may depend on the respondent's ability to make the payment and the nature of the aggrieved woman's needs.
