Description

Introduction

Public servants hold positions of authority and responsibility in society. If an individual falsely impersonates a public servant, they can misuse power, deceive people, or commit fraud.

To prevent such offenses, Section 170 IPC punishes individuals who dishonestly pretend to be public servants and act as if they have official authority.

  1. The accused must falsely personate a public servant

    • The person must pretend to be a government official, police officer, magistrate, or any other public servant.
    • Simply lying about one’s job is not enough—the person must act as a public servant.
  2. The impersonation must be intentional

    • The person must knowingly and deliberately deceive others.
  3. The accused must act under false authority

    • The person must perform or attempt to perform an official duty while impersonating a public servant.

For example, if someone pretends to be a police officer and demands money from shopkeepers, they can be punished under Section 170 IPC.
