Section 171B IPC defines bribery in electoral processes, ensuring punishment for those who corrupt democratic practices.
Key Elements of Bribery Under Section 171B IPC
Bribery Includes Two Actions:
Giving Bribes (Active Bribery) –
- Offering or giving money, gifts, jobs, contracts, or favors to influence a person’s vote.
- Example: A politician offering cash to voters in exchange for votes.
Accepting Bribes (Passive Bribery) –
- Taking money, gifts, or promises of benefits in exchange for voting a certain way.
- Example: A voter accepting money to vote for a particular candidate.
Bribery is an Offense Unless Done for Public Welfare
- Giving free transportation, food, or public services is NOT bribery if done legally and for the public good.
Punishment

- Imprisonment for up to 1 year, OR
- Fine, OR
